18 USC § 2252B

Here’s the text of 18 USC § 2252B, Misleading domain names on the Internet:
(a) Whoever knowingly uses a misleading domain name on the Internet with the intent to deceive a person into viewing material constituting obscenity shall be fined under this title or imprisoned not more than 2 years, or both.
(b) Whoever knowingly uses a misleading domain name on the Internet with the intent to deceive a minor into viewing material that is harmful to minors on the Internet shall be fined under this title or imprisoned not more than 4 years, or both.
(c) For the purposes of this section, a domain name that includes a word or words to indicate the sexual content of the site, such as “sex” or “porn”, is not misleading.
(d) For the purposes of this section, the term “material that is harmful to minors” means any communication, consisting of nudity, sex, or excretion, that, taken as a whole and with reference to its context—
(1) predominantly appeals to a prurient interest of minors;
(2) is patently offensive to prevailing standards in the adult community as a whole with respect to what is suitable material for minors; and
(3) lacks serious literary, artistic, political, or scientific value for minors.
(e) For the purposes of subsection (d), the term “sex” means acts of masturbation, sexual intercourse, or physcial [1] contact with a person’s genitals, or the condition of human male or female genitals when in a state of sexual stimulation or arousal.

Michael Palage to Speak on Sept. 25

It looks as if former ICANN Board Member Michael Palage (and long-time ICANN insider and gadfly) will make his annual appearance on Monday, Sept. 25.
Please, be sure to read the .xxx materials (very easy reading, I promise!) — I’m sure he’ll have a lot to say about this controversy!
Here’s his official bio from ICANN:
Michael Palage is an intellectual property attorney and an information technology consultant. He holds a Bachelors of Science in Electrical Engineering from Drexel University, and a Juris Doctorate from the Temple University School of Law. Mr. Palage is admitted to the bars of both Florida and Pennsylvania.
Mr. Palage has been actively involved in ICANN policy since its formation in connection with his former role as Chair of the ICANN Registrar Constituency. He formerly served as the former Chair of ICANN’s Working Group B and currently serves as a WIPO UDRP panelist. Mr. Palage currently provides consulting services to domain name registration authorities and has testified as an expert witness in a number of Internet related matters.
Michael Palage was selected for the ICANN Board by the Generic Names Supporting Organisation. He served on the Board from April 2003 to 3 April 2006.

Jurisdiction Thread

I invite your questions / comments about the jurisdiction readings and the issues they raise.
In particular, it would help us have a better discussion of the materials in unit 6 (which we won’t get to until Wednesday) if some fraction of the class — perhaps the people on call, perhaps people who like me always seem to do better writing out their thoughts than speaking them — would post some thoughts about the question posed in the syllabus at the end of Section 6. There’s a lot of reading there, so if you can do it by Tuesday night, that’s great, but if not there’s a decent chance the discussion will run on into next week.

As always, remember that if you want class participation credit for your online participation (trust me, you do), you need to include your real surname either in your username or at the end of the post or comment.

I’ve added the next chunk of assignments to the Syllabus. For your printing convenience, I also have listed them below. In case of any error or conflict, treat the Syllabus as the controlling copy. Materials should be available from the distribution center tomorrow.
